Privacy Policy

We collect information in three ways: directly from you, automatically through the Site, and from third-party partners.

Information you provide directly

This includes information you submit when you:

• Create an account or log in (name, email address, login credentials, account preferences)
• Register for an event or purchase tickets (name, email address, billing information processed by our ticketing partner, event preferences)
• Make a donation (name, contact information, and donation details processed by our payment partner)
• Submit a form through the Site, including volunteer applications, artist submissions, sponsor and partner inquiries, press and media inquiries, newsletter signups, and general contact forms
• Communicate with us directly by email or through the Site (the contents of your messages and your contact details)

For each of these form types, the information you provide is used only for the purposes related to that submission, as described in Section 3 below.

Information collected automatically

When you visit the Site, we and our service providers may automatically collect:

• IP address and approximate geographic location derived from it
• Browser type, version, and language settings
• Device type and operating system
• Pages visited, links clicked, time spent on the Site, and navigation paths
• Referring website or URL (how you arrived at the Site)
• Session identifiers and similar technical data

This information is collected through cookies and similar tracking technologies, described in detail in Section 6.

Information collected at events

If you attend an Eden event, we or our authorized photographers, videographers, and media partners may capture your likeness in photographs, video recordings, and audio. This is described in detail in Section 9.

Information received from third parties

We may receive information about you from third-party platforms when you interact with Eden through them — for example, when you purchase a ticket through a ticketing platform, make a donation through a payment processor, or connect your social media account to an Eden form or registration. The information we receive is limited to what those platforms share in connection with your transaction or interaction with Eden.

We use the information we collect for the following purposes:

• To operate and maintain the Site and ensure it functions correctly
• To create and manage user accounts
• To process event registrations, ticket purchases, and donation transactions
• To send transactional communications related to your registrations, applications, donations, and account activity
• To send marketing and newsletter communications, where you have given your consent (see Section 5)
• To evaluate volunteer applications, artist submissions, partnership and sponsorship inquiries, and press and media requests
• To manage our contact database and CRM workflows, including following up on form submissions with relevant program information
• To understand how the Site is used and improve its functionality, performance, and content
• To comply with our legal obligations, including nonprofit financial record-keeping requirements
• To protect the security and integrity of the Site and prevent fraud or misuse

We do not use your personal information to train artificial intelligence or machine learning models, and we do not authorize our service providers to do so on our behalf.

Different types of submissions are used for specific purposes. Here is how we handle each:

Volunteer applications

Information submitted through volunteer application forms is used to evaluate your application, communicate with you about volunteer opportunities, coordinate logistics, and maintain records of Eden’s volunteer program. It is not used for unrelated marketing purposes without your separate consent.

Artist submissions

Portfolio materials, bios, proposals, and related information submitted through artist application forms are reviewed by Eden’s programming team for the purpose of curatorial selection and program planning. Submitted materials are treated with respect for your intellectual property and are not shared externally without your consent.

Sponsor and partner inquiries

Information provided through sponsorship and partnership inquiry forms is used to evaluate the opportunity and follow up with you about potential collaboration. It may be shared internally with Eden’s development and programming leadership.

Press and media inquiries

Contact information and inquiry details submitted by press and media contacts are used to respond to your request and to maintain a press contact list for Eden event communications.

Donor information

Please see Section 10 (Donor Privacy) for specific information about how we handle donor data.

We work with third-party service providers to operate the Site and deliver our programs. These providers may process your information on our behalf under data processing agreements that limit how they may use your data. We encourage you to review the privacy policies of any third-party platforms you use in connection with Eden.

Our key service providers include:

CRM and marketing communications

We use Go High Level (GHL), a customer relationship management and marketing automation platform, to store contact records, manage form submissions, send email communications, and run workflow automations. Information you submit through Site forms may be stored and processed within GHL.

Ticketing platforms

Event registrations and ticket purchases are processed through third-party ticketing platforms. Those platforms’ own privacy policies govern the data they collect during checkout. Eden receives registration and contact information necessary to manage event logistics.

Donation processing

Donations are processed by third-party payment and donation platforms. Eden does not store full payment card numbers or other sensitive financial credentials. We receive confirmation of donation amounts and donor contact information for acknowledgment and record-keeping purposes.

Website analytics

We may use tools such as Google Analytics or similar services to understand traffic patterns and user behavior on the Site. These tools typically collect data in aggregated or anonymized form. You can opt out of Google Analytics tracking at tools.google.com/dlpage/gaoptout.

Website hosting and infrastructure

The Site is hosted on third-party infrastructure providers who maintain their own security and privacy practices in accordance with industry standards.

Eden does not authorize its service providers to use your personal information for their own independent marketing or commercial purposes.

We send two types of email communications:

Transactional emails

These are sent in direct response to your actions — such as registration confirmations, application acknowledgments, donation receipts, event reminders, and account-related notices. Transactional emails are sent as part of Eden’s core operations and do not require a separate marketing opt-in.

Marketing and newsletter emails

These promote Eden’s events, programs, opportunities, and community news. We will only send marketing emails with your express consent, obtained either through a dedicated opt-in form or as part of a registration process that clearly discloses this communication type.

How to unsubscribe

You may unsubscribe from marketing and newsletter emails at any time by clicking the “Unsubscribe” link included in every marketing email, or by contacting hello@edenartsfestival.org. Unsubscribing from marketing emails does not affect transactional communications related to services or programs you have requested.

Our CRM platform (Go High Level) may send automated follow-up emails when you submit certain forms — for example, an acknowledgment after a volunteer application or artist submission. These automations are configured to be relevant to the action you took and are not used for unrelated commercial outreach.

We and our service providers use cookies, pixel tags, web beacons, and similar tracking technologies on the Site. These tools help us operate the Site, understand how it is used, and support our communications.

We use the following categories of tracking technologies:

Strictly necessary

Required for the Site to function — for example, to maintain your session when you log in or complete a multi-step form. These cannot be disabled without affecting core Site functionality.

Analytics and performance

Help us understand how visitors interact with the Site: which pages are most visited, how long users stay, and where they encounter difficulties. Data collected is generally aggregated and used to improve the Site.

Marketing and communications

Track interactions with Eden emails and forms, including whether emails were opened or links were clicked. This helps us understand the effectiveness of our communications and send more relevant follow-ups. These may include pixel tags embedded in emails sent through our CRM.

Managing your cookie preferences

You may adjust your browser settings to block or delete cookies at any time. Note that disabling certain cookies may affect your ability to use features of the Site. For Google Analytics specifically, you may opt out using the browser plugin at tools.google.com/dlpage/gaoptout.

Do Not Track

Some browsers transmit “Do Not Track” (DNT) signals. The Site does not currently alter its data collection practices in response to DNT signals, as no uniform standard for honoring them has been established. We will update this disclosure if our approach changes.

Eden does not sell your personal information. We do not share your personal information with third parties for their own independent commercial or marketing purposes.

We may share your information in the following limited circumstances:

• With service providers and vendors who assist in operating the Site and delivering our programs, under data processing agreements that restrict their use of your data (see Section 4)
• With program-specific partners directly involved in delivering an Eden program or event for which you have registered or applied — for example, sharing attendee logistics information with a venue or co-presenter
• With legal or regulatory authorities when required by applicable law, court order, or to protect the rights, safety, or property of Eden, its staff, artists, volunteers, or the public
• In connection with a merger, acquisition, dissolution, or transfer of Eden’s assets, in which case we will notify affected users and ensure the receiving organization is bound by privacy commitments no less protective than this Policy

When we share information with program-specific partners, we limit the sharing to what is necessary for that program and do not authorize those partners to use the information for unrelated purposes.

Security practices

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include access controls limiting who within Eden can view personal data, use of reputable third-party platforms with their own security practices, and secure transmission of data over encrypted connections where applicable.

However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, and we encourage you to use strong, unique passwords and to contact us promptly if you suspect unauthorized access to your account.

Breach notification

In the event of a security breach that affects your personal information, Eden will notify affected individuals in accordance with applicable law — including Utah’s data breach notification requirements under Utah Code § 13-44-202, which require notification within 30 days of discovering a qualifying breach. Notification will be provided by email to the address associated with your account or submission, or by other legally permissible means.

Eden and its authorized photographers, videographers, and media partners may capture photographs, video recordings, and audio at Eden events and programs. This content documents Eden’s work and mission and may be used for:

• Promotional and marketing materials, including the Site, social media, and print
• Press releases and media distribution
• Grant applications, donor reports, and nonprofit communications
• Educational, archival, and organizational documentation

By registering for or attending an Eden event, you acknowledge that you may be photographed or recorded in event settings and grant Eden a non-exclusive, royalty-free, worldwide license to use your likeness as described above.

We do not sell event photographs or footage to commercial third parties for advertising purposes unrelated to Eden.

If you have specific concerns about the use of your likeness, or if you would like to request that a particular image or recording be removed from Eden’s promotional materials, please contact hello@edenartsfestival.org. We will make reasonable efforts to honor such requests, subject to the practical limitations of live event documentation and materials already in distribution.

Eden is committed to protecting the privacy and trust of its donors. Donor names, contact information, and giving history are used solely for:

• Processing donations and issuing acknowledgment letters or tax receipts
• Maintaining financial records as required by IRS regulations applicable to nonprofit organizations
• Communicating with donors about Eden’s mission, impact, and programming, where consent has been given

Eden does not sell, trade, rent, or share donor lists with other organizations for their own solicitation or marketing purposes.

Donors who wish to remain anonymous in any public recognition or donor acknowledgment may request this at any time by contacting hello@edenartsfestival.org. Anonymous donations are processed and recorded internally in compliance with applicable law.

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. When data is no longer needed, we take reasonable steps to delete or de-identify it securely.

As a general guide, we apply the following retention timelines:

• Account data: retained for the duration of your active account, and for a reasonable period thereafter in case of reactivation or dispute
• Event registration and attendance records: retained for up to three (3) years after the event date for organizational, reporting, and grant documentation purposes
• Donation records: retained for a minimum of seven (7) years in compliance with IRS requirements applicable to nonprofit financial records
• Volunteer and artist application data: retained for up to two (2) years after the relevant application cycle closes, unless you request earlier deletion
• Marketing contact records: retained until you unsubscribe or request deletion
• Automatically collected technical data (logs, session data): retained for a shorter period, typically 90 days, unless required for security investigation

Some information may be retained longer if required by law or necessary to protect Eden’s legal rights. If you have questions about retention of a specific category of your data, please contact hello@edenartsfestival.org.

Depending on where you live, you may have specific rights regarding your personal information. Eden is committed to honoring these rights in good faith and responding to requests promptly.

Utah residents — Utah Consumer Privacy Act (UCPA)

Under the Utah Consumer Privacy Act (effective December 31, 2023), Utah residents have the right to:

• Confirm whether Eden is processing your personal data and access a copy of it
• Request correction of inaccurate personal data Eden holds about you
• Request deletion of personal data you have provided to Eden, subject to applicable exceptions
• Obtain a portable copy of your personal data in a commonly used, machine-readable format
• Opt out of the sale of your personal data (Eden does not sell personal data)
• Opt out of the use of your personal data for targeted advertising

All users

Regardless of your location, you may also:

• Opt out of marketing emails at any time (see Section 5)
• Request correction of inaccurate account or contact information
• Request deletion of your account and associated data by contacting us

How to submit a request

To exercise any of the above rights, please email hello@edenartsfestival.orgwith the subject line “Privacy Rights Request” and a description of your request. We will respond within 45 days. For complex or high-volume requests, we may extend this period by an additional 45 days with prior notice.

We may need to verify your identity before processing your request. We will not discriminate against you — including by denying services, charging different prices, or providing a lower quality of service — for exercising your privacy rights.

Appeals

If we decline to act on your request, we will explain our reasoning in writing within the applicable response window. If you disagree with our decision, you may appeal by emailing hello@edenartsfestival.orgwith the subject line “Privacy Rights Appeal.” We will respond to appeals within 60 days.

The Site is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent.

Users between the ages of 13 and 17 may use the Site with the consent of a parent or legal guardian. If you are a parent or guardian and believe your child has submitted personal information through the Site without your knowledge or consent, please contact us at hello@edenartsfestival.org. We will take prompt steps to review and, where appropriate, delete the information.

Eden’s events and educational programs may involve participation by minors. In those contexts, Eden follows applicable legal requirements for the collection and use of information about minor participants, including obtaining appropriate consents through event-specific registration or participation agreements.

This section applies to users located in the European Union, the United Kingdom, or other jurisdictions with data protection laws that require a stated legal basis for processing personal information (such as the EU General Data Protection Regulation, or GDPR).

Where applicable, Eden processes your personal information on one or more of the following bases:

• Consent: for marketing communications, newsletter subscriptions, and optional features where you have given clear, affirmative consent
• Performance of a contract: for processing event registrations, ticket purchases, applications, and other services you have requested from us
• Compliance with a legal obligation: for financial record-keeping, donation acknowledgment, and other obligations imposed by applicable law
• Legitimate interests: for Site analytics, security monitoring, fraud prevention, and follow-up communications related to submitted inquiries, where those interests are not overridden by your rights

If you are located in the EU or UK and have questions about the legal basis applicable to a specific use of your data, or wish to exercise rights under the GDPR (including the right to lodge a complaint with your local supervisory authority), please contact hello@edenartsfestival.org.

Eden reserves the right to modify this Privacy Policy at any time to reflect changes in our practices, technology, legal requirements, or for other operational reasons.

When we make material changes, we will update the Effective Date at the top of this document and, where practicable, notify registered users by email or through a prominent notice on the Site. We encourage you to review this Privacy Policy periodically.

Your continued use of the Site after changes take effect constitutes acceptance of the updated Privacy Policy. If you do not agree with the changes, you should discontinue use of the Site and may request deletion of your account by contacting us.
